Terms & Conditions

By placing an order on this Website or when calling our customer services team to place an order, you are agreeing to the following terms and conditions. These terms and conditions do not in any way affect your statutory rights as a consumer.

Placing your order

1.1 When you submit your order by clicking on the ['Place My Order'] button or by calling our customer services team, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing elsewhere on the Hayford & Rhodes Website.

1.2 Your order to us is an offer which we may or may not accept and we will not be bound by a contract with you until and unless, we have received from you all the payment details we require for the goods ordered by you, your payment to us has been authorised by your card issuer and we have issued an email acknowledging your order. Your order will not be processed if full payment details are not received by us.

1.3 Orders placed on Saturdays, Sundays or Bank Holidays will be treated as having been received on the following working day.

1.4 An order will be acknowledged via e-mail confirming your details, provided you have supplied us with a correct e-mail address, which is most important. Our e-mail will provide an order reference number for any future correspondence. All prices and charges will be calculated of those ruling at the time at which you place your order.

1.5 For your order to be processed and delivered on the requested date, you must supply us with all the relevant details we request, including full delivery details, postcode and telephone number.

1.6 At our discretion from time to time, we may offer products at discounted prices. These offers are valid from the time that we introduce them to the end date of the offer and they cannot be used for purchases before the offer introduction date or after the offer end date.

1.7 In the event that you have made a purchase and the price of a product falls or is discounted due to a special offer, the price of the product at the time of purchase shall 'prevail'. We are unable to offer special offer discounts for purchases that have already been made. As our special offers are often made available due to the availability of products, we may change the terms of special offers, or withdraw them altogether, at any time and without prior notice. We also reserve the right to offer different personalised special offers and promotions and it will therefore only be possible for the customer in receipt of the special offer to redeem the discount.

Payment

2.1 Payment may be made by any of the methods indicated on the payment page of the Website and will be debited when you submit your order.

2.2 Occasionally credit cards that are entered correctly and have sufficient funds are not validated because the card issuer is performing a random security check. In these cases, we will need to take payment over the phone. We will email or call you in these circumstances. If you receive a message to tell you that payment has not been validated, please contact our customer service team on 020 7248 5312 immediately to ensure your order can be attended to.

2.3 Due to time differences, payments made out of office hours, or problems getting hold of you via the contact details you have provided, we are sometimes unable to process a valid payment prior to the requested delivery date. If this is the case, once we have received payment, we will dispatch the goods ordered as soon as we can to minimise any further delay. Although this delay is regrettable, it is outside our control and therefore we cannot offer any form of refund in these circumstances.

Changes & Cancellations

3.1 If you wish to make any changes to your order please call our customer services team on 020 7248 5312. Please note that any changes to your order (delivery address, gift message) must be made at least 2 working days prior to delivery to ensure that we have time to amend the order prior to dispatch. We cannot guarantee to accept changes made to your order after that time. Any change to your order may affect the price to be paid by you and our acceptance of your requested change will then be subject to any additional price or charge being received by us

3.2 Only requests for cancellations that are made at least 2 working days before the intended delivery date will be considered by us. Although we will usually accept such a cancellation we do not guarantee to do so on every occasion. Where a requested cancellation is received by us on a Saturday, Sunday or Bank Holiday it will be treated as having been received on the following working day. To request order cancellation, please call 020 7248 5312.

Delivery

4.1 We deliver to any valid postal address in the UK. Next-day delivery is possible only for goods for which we have received your order before 3.30 pm Monday to Friday, except for more remote locations within the UK where delivery can take up to 48 hours. Deliveries will be only be despatched from Monday to Friday.

*Courier Deliveries to the following destinations may take 48 hours: Aberdeen, Dundee, Falkirk, Western Isles, Inverness, Isle of Skye, Isle of Arran, Isle of Cumbrae, Isle of Kirkwall, Orkney, Paisley, Isle of Jura, Isle of Colonsay, Isle of Coll, Isle of Eigg, Isle of Rhum and Isle of Canna, Perth, Holy Island, Isle of Scilly, Shetland Isles and Northern Ireland. All postal deliveries may take 48 hours.

4.2 Please note all deliveries made outside of the UK will be directed through our Teleflorist service.

4.3 A recipient signature will be required for courier deliveries.

Should the recipient be away at the time of delivery, a card will be left stating attempted delivery was made. The recipient will then have to collect the package from the local depot or arrange for re-delivery.

Deliveries for hospitals, military bases and business addresses will be delivered to a main reception or mailing room prior to internal distribution. We recommend that deliveries to these locations be requested for a weekday and not on a Saturday. Deliveries cannot be made to PO Box addresses. All orders for delivery to hospitals must include the ward name and or number in the relevant address field.

Our delivery service is NOT available on Sundays or UK public holidays or the day after a public holiday. Where orders have been placed for delivery on any of these dates and we are unable to contact you in time then, where we can, we will deliver the goods the day before the date requested.

4.7 Under normal circumstances, we will try to ensure that your order is delivered to the recipient's address you provide. However, there are times when this is not possible due to problems with the address information or other difficulties. To alleviate such problems please:

  • Ensure that the recipient address you provide is full and accurate, including the address and postal code.
  • Give additional instructions to assist our drivers with difficult-to-find addresses.
  • Keep us informed if you find that the recipient's address or availability changes prior to the order being delivered.
  • Supply a contact number for the recipient so that if our driver is having problems with delivery they can contact them directly.
  • Provide a "leave safe" area option if the recipient is not in when our driver attempts delivery.

We will not be responsible for any orders which are not delivered due to incorrect or incomplete information being supplied by you or due to the absence of a recipient.

4.8 Where we can we will attempt to obtain a signature from the intended recipient of the delivery. In some circumstances, for example, when delivering to a hospital or university, we may not be able to deliver directly to the intended recipient. In this case, we will deliver to the reception area and seek to obtain a signature from the receptionist (or equivalent). This signature will be our record of delivery.

Availability

5.1 All products are subject to availability, and acceptance of your order. In the event of any supply difficulties or if the products we have received from our suppliers that are needed to make up your order do not meet our high quality standards, we reserve the right to substitute an alternate product of a similar style and equivalent (or greater) value and quality. Flowers may be delivered in bud to ensure longer life.

5.2 Where substitution of goods is necessary, we will try to contact you via email. If you wish to discuss the substitution we have made, please contact our customer services team. If we are unable to contact you via the contact methods provided prior to the time that we make up your order, we will assume that you accept the substitution.

Force Majeure

6.1 Neither we, nor any courier or postal service that we use shall be liable for any failure or delay in performance where such failure or delay results from any circumstances outside our reasonable control, including, but not limited to, any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.

Your Messages

7.1 You must agree that any messages provided by you to be sent by us on your behalf to a third party will not contain anything which could be construed as harassing, threatening, vulgar, abusive, obscene, defamatory, racist or which may cause embarrassment or distress to any person or are otherwise unlawful or objectionable.

7.2 You are entirely responsible for any such message and we accept no liability whatsoever for any such content. We do not routinely screen messages, but may monitor content from time to time. We have the right to refuse to send or display messages and terminate access to the relevant services at any time and without liability to you in the event that any message seems to us to be objectionable.

Personal Information

To ensure that we can communicate effectively with both customers and recipients, it is very important that you provide accurate personal information. Please remember that we value your privacy and will never lease, rent or sell your private information. For more information, please see our Privacy Policy.

At the checkout, we ask for the following personal information:

Customer email address - we use this information for the purpose of order acceptance, informing you of the order status and in the event that we need to make substitutions.

Customer full name and address - we use this information for credit card validation and for direct mailing (if you have agreed to receipt of these mailings).

Customer telephone number (and mobile number) - we use this information to contact you in the event of problems with the order such as payment failures or delivery problems.

Recipient full name and address - we use this information in order to be able to deliver the goods you have ordered.

Recipient telephone number - we use this information to contact the recipient in the event of a problem delivering your order. We will not contact the recipient under any other circumstances.

We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.

Dealing with problems

9.1 Although we do our best to ensure that this does not happen, on rare occasions, goods arrive at their destination damaged. If the recipient receives damaged goods, please contact us immediately so that we can arrange a replacement for the next available delivery date.

9.2 In order for us to resolve any complaints quickly and to our mutual satisfaction, and in view of the nature of the goods we deal in, we request that you make any complaint within 1 day of the date of delivery or intended delivery of your purchase.

9.3 Because of their perishable nature, flowers are non-returnable. This does not affect your statutory rights. If you are not completely satisfied with the goods we supply please call our customer service helpline on 020 7248 5312 from 9 am to 6 pm, Monday to Friday, quoting your order reference number or email us on info@hayfordandrhodes.co.uk.

Limitations & Exclusions

10.1 We use our reasonable endeavours to ensure that the Hayford & Rhodes Website and/or the services we provide (Services) are fully operational and error-free but we cannot guarantee this and, therefore, accept no responsibility for any errors, defects and/or interruption of the Hayford & Rhodes Website or Services.

10.2 We accept liability for death and/or personal injury arising from our negligence and from that of our employees, servants or agents and for all liability arising from any fraudulent representation we may make.

10.3 Subject to clause 10.2, our liability in contract, tort (including negligence and breach of statutory duty) or otherwise arising by reason of or in connection with your order placed with us or in connection in any way with the Services shall be limited to a multiple of 2 times the price you have paid for the relevant Hayford & Rhodes Products.

10.4 Subject to clauses 10.2 and 10.3 and to the full extent permitted by the applicable law above we exclude all liability for any and all claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Hayford & Rhodes Website and/or the Services, whether arising in contract, tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the Hayford & Rhodes Products supplied.

Warranties, Disclaimers
& Indemnity

11.1 Whilst we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy or completeness of the material on this Website. We may make changes to the material on this Website or to any services or prices described in it, at any time without notice. The material on this Website may be out of date, and we do not make any commitment to update this material.

11.2 The content, information and material on this Website is provided "as is" without any conditions, warranties or other terms of any kind.

11.3 Some flower bouquet contents and/or other goods may be harmful if eaten and/or a skin irritant. Please call our customer helpline on 020 7248 5312 if you wish to enquire about the safety of contents before ordering.

11.4 You shall fully indemnify Hayford & Rhodes Limited, its suppliers, officers, directors, employees, shareholders and agents for any loss or damage suffered by any of them as a result of breach of your obligations under these Terms and Conditions.

12.1 The copyright and other intellectual property rights in all content and material on this Website (including without limitation the name "Hayford & Rhodes", photographs, logos, trade marks and graphical images) are owned by Hayford & Rhodes Limited or its licensors, unless otherwise stated or indicated. All rights which are not expressly granted in these Terms and Conditions are reserved.

12.2 You may not print and download extracts from or modify any contents from this Website. No part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service or used other than for the intended purpose. You may not publish, distribute or otherwise reproduce in any format any of the content or copies of the content of this Website without our prior written permission which we may withhold at our sole discretion.

12.3 Links to third party websites on this Website are provided solely for your convenience. If you use these links, you leave this Website. We have not reviewed all of these third party websites and do not control, and are not responsible for these websites or their content or availability. We do not therefore endorse or make any representations about these websites, or any material found there, or any results that may be obtained from using them. 14.9 Your purchase will be deemed to have occurred in England. These Terms and Conditions and the relevant contract between us shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

Delivery Information

Next Day Deliveries to England, Wales and Scotland
Our nationwide delivery service is available from Tuesday - Saturday.

Nationwide delivery times are between 9am - 6pm Tuesday to Friday and before 12pm on Saturday. Unfortunately, we are unable to deliver nationwide fresh flowers on a Monday or Sunday. Orders for delivery on Monday will be directed through our Teleflorist service.

If you place an order by 1pm we can deliver to the majority of the UK the next day. The only exceptions are the Highlands & Islands of Scotland and some parts of Northern Ireland - if you need to deliver here, please contact us to discuss.

Same Day Deliveries to London
We can take orders for same day delivery in London up until 1pm Monday to Friday. We do make deliveries in London on Saturdays, but the orders must be placed on Friday to ensure delivery Saturday morning.

Standard delivery is between 9am - 6pm. If you require an AM delivery we will do our very best to assist you at no extra cost, but we cannot provide a guarantee.

International Deliveries
We deliver internationally. Delivery does vary according to the destination, but we do our very best to get them to the recipient within 2 working days.

Charges
To keep the price down for our customers we do not profit from our delivery service. All charges are at cost price.

Prices are displayed on your order before you commit

Delivery instructions
Please provide information that will assist us in finding the delivery address. It is also very helpful to recommend where to leave the flowers if there is no one at home. Customers often suggest a neighbour or a safe, concealed spot. In the event there is no one at the address and no alternative delivery arrangement made, a notice will be posted through the letterbox advising the recipient to contact us and re-arrange delivery. This is at no extra cost.

Hand tied and gift wrapped flowers are delivered in a water bubble ('aqua-pack') which are delivered in our flower boxes. The boxes are designed exclusively for the transportation of flowers to help them arrive in the best possible condition.

In central London we deliver most of our flowers using our own distribution team, for other parts of the country we use experienced couriers who we work closely with to ensure that the flowers and plants reach their destination in the best condition.

Privacy Policy

We are all sensitive to privacy issues on the Internet. We believe that it is important for you know how we treat the information about you that we receive on the Internet and so we set out below our privacy policy and we advise you to read it. Consider it carefully before you send any of your personal data to us and only do so if this policy is acceptable to you.

From time to time we make changes to our policy. Any such changes will be posted on this Website and where we think it is appropriate we may inform you of changes by email.

Data we may collect

There are two types of data which we may hold about you as well as data which you provide about third parties to whom we are to make deliveries.

Firstly, you may visit our website without telling us who you are or giving us any personally identifiable information about you. Our servers collect the domain names, ip addresses* and other details about such visitors.

(* IP address - the Internet Protocol address is an identifier allocated to a computer using the Web).

This information may be used to measure the number of visits, provide information about the frequency of visits and which pages seem to attract the most attention. We use this type of information to measure the use of our website and to improve the content. When you visit our site we send a cookie** to your computer.

A cookie collects user information which we use to enhance your experience of our website. The information collected in this way can be used to identify you unless you modify your browser settings so as to not accept cookies. Secondly, when you wish to place an order with us, whether through the website or through our telephone ordering service, we need to collect the information about you necessary to process your order and obtain payment. Such information includes email addresses and other personally identifiable information such as first and last name, home or other physical address, telephone number and payment card details. There may be other information we need about you in specific cases or which we may request for market research and similar purposes. We refer to this below as your data.

Unless an order you place is for yourself, we also need to collect the information necessary for us to be able to deliver your order to the intended recipient. We refer to this below as third party data.

What we do with the data

We use your data primarily to enable us to fulfil your order and obtain payment. We may also use it for market research and customer satisfaction purposes and so that we can administer, support, improve and develop the services that we offer. We may contact you from time to time to let you know of our various products and services which we believe may be of interest to you. We will not email you in future unless you have given us your consent (except for the purpose of confirming and fulfilling your orders, or as we have otherwise mentioned in this Policy).

We use third party data so that we can complete a delivery to that third party, we will not use it for any other purposes except that we may contact such third parties in the future to check if they are satisfied with our services and ask if they are interested in receiving further information from us about our products and services.

We may share some of your data and any third party data with carefully selected service providers with whom we work, couriers for example, who will need names and addresses, to provide services to you and who enable us to carry out our business.

We will not transfer your data or third party data outside the European Economic Area for uses other than to fulfil your orders without first obtaining your consent.

We do not retainyour data or third party data for longer than we require for the purposes that we have mentioned. When we destroy or delete any such data, held either electronically or on paper, we make every reasonable effort to do so in secure circumstances.

Your rights in connection with your data

You have the right to see your data. You may ask us to make any necessary changes to ensure that your data is accurate and kept up-to-date. If you wish to check the details you have submitted to us, you may do so by contacting us. We are entitled by law to charge you a fee, currently £10, to meet our costs in providing you with details of your data.

Security

We will take all reasonable measures as required under the UK Data Protection Act 1998 to ensure that your data and third party data is retained by us in a secure manner and protected from unauthorised use or disclosure. If we share any such data with third parties in accordance with this Policy, we will take all reasonable measures to ensure that such third parties also take appropriate security measures in relation to it.

Care Guide

Bouquets and Flowers

  • On arrival, remove flowers from packaging and re-cut stems by removing one to two inches with a sharpe knife. Do not smash or pierce the stems as this destroys the water vessels and inhibits water uptake.
  • If you want to retain the shape of a hand tied bouquet do not remove the string tied around the stems.
  • To discourage bacteria growth remove all leaves that would be below the water line. This will increase the life expectancy of your flowers.
  • Fill a vase three quarters of the way up with lukewarm water and add the flower food provided following the instructions on the sachet. Add the flowers with re-cut stems and lower leaves removed.
  • Avoid putting your display near direct heat or sunlight. Try to keep them in a cool place.
  • Changing the water everyday and re-cutting the stems every 3-4 days will make your flowers last longer.
  • If your flowers arrive by post and appear wilted this may be due to the fact they have been without water. Place them in water as soon as possible and the stems and buds should firm up as they re-hydrate.
  • Don't put flowers near ripening fruit - it releases tiny amounts of ethylene gas which prematurely ages flowers. Dying flowers do the same so always remove them from the vase.

Arrangements

  • The displays are hand arranged in an oasis block.
  • Keep the oasis block moist with fresh water every 2-3 days.
  • Make sure the surface you place this product on is protected to prevent scratching or staining.

Planted

  • Plant soil should be kept moist at all times and soil should not be allowed to dry out or the plant allowed to wilt.
  • Do not over or under water. We find watering them from below is the best way to avoid this problem - stand them in a dish of water until all the plant has taken up the water it needs.
  • Don't leave the plant sitting in water, always empty dish after watering.
  • Always use lukewarm, room temperature water, never use cold water.
  • Flowering plants should be de-headed regularly to maintain quality.
  • Make sure the surface you place this product on is protected to prevent scratching or staining.
